On March 23, 2010, President Obama signed into law the Patient Protection and Affordable Care Act (P.L. 111-148) (i.e. “PPACA” or “Obamacare”). PPACA’s “employer mandate” penalizes certain employers who do not offer affordable coverage to its employees. In addition, PPACA also requires, beginning in 2014, the creation of state-based “Exchanges,” through which individuals and small businesses can purchase coverage. These Exchanges will offer coverage without, among other things, any exclusion for pre-existing conditions.
